Cigarette Manufacturers Will Soon Have To List Chemicals In Products

April 10, 2012

Cigarettes are known to contain preservatives and harmful chemicals. Yet manufacturers of tobacco products aren’t required to list those chemicals. Instead, the manufacturers are only required to provide a warning that the product may cause cancer and other health problems.

However, that could change if the U.S. Food and Drug Administration (FDA) passes new guidelines for the tobacco industry. According to KVUE News, the FDA is considering forcing manufacturers of tobacco products to list any additives on the outside packaging of a pack of cigarettes.

Dr. Lawrence Deyton, director of the FDA’s Center for Tobacco Products, told reporters that “cigarettes are the only mass-consumed product in this country for which consumers don’t know what’s in them, until now.”

The agency made the announcement Friday, adding that cigarettes contain more than 7,000 chemicals in tobacco products, and that at least 93 of them are harmful to a person’s health. The change will be implemented next year.

The move comes after a 2009 law change gave the FDA a large share of power when it comes to controlling the marketing and manufacturing of tobacco products and is being seen as a first step in tighter regulation of the industry as alternative tobacco products have begun to emerge.

The Texas Defective Product Lawyers with Daniel Stark Injury Lawyers hope that the new warnings will deter people from picking up the habit of smoking and will encourage current smokers to stop.

Nine Austin Residents Hospitalized With Carbon Monoxide Poisoning

February 14, 2012

Nine residents of a north Austin apartment complex required hospital attention from carbon monoxide poisoning while in their homes Sunday. According to reports from KVUE News, the gas leak caused carbon monoxide levels in the homes to reach up to 600 parts per billion. A normal home should not exceed 35 parts per billion.

The gas leak was discovered after a young boy was found unconscious in one of the units. Paramedics were immediately called to the scene where they treated residents for symptoms ranging from nausea to headaches. They were treated at St. David’s Medical Center for serious but non-life threatening injuries. All were eventually released from the hospital with their lives, but with hefty medical bills to show for it.

Austin Fire Department Battalion Chief Palmer Buck says the tenants in the apartments were missing face plates on their heating units. The air wasn’t ventilating through the pipes, so carbon monoxide was leaking into their units. Meanwhile, the Texas Gas Company found other leaks coming from an appliance in one of the units and said the gas had spread to the two adjacent units.

The Austin Personal Injury Lawyers with Daniel Stark Injury Lawyers suggest that homeowners should purchase a carbon monoxide detector and have it installed immediately if your home uses gas appliances. Also, it is important to have a licensed plumber inspect the gas lines in your home once a year to ensure there are no leaks.

Holiday Ladder Falls Claim Two Lives In Texas

December 13, 2011

With the holidays in full swing, the number of slip and fall accidents across the state of Texas is on the rise. According to KVUE News, a 54-year-old Little Elm, Texas, woman was killed after falling from a wooden pull-down ladder she was using to access Christmas decorations in her attic.

Police spokesman, Captain Rodney Harrison, stated that the woman was alone at her home on Fieldstone Drive when the accident occurred Saturday afternoon. Investigators said that the ladder appeared to have given way when the woman stepped up onto the ladder. She fell backwards and hit her head on the concrete floor beneath her, causing severe trauma. By the time her husband found her several hours later, there was nothing that could be done to revive her.

It was also reported that a month earlier, a 52-year-old town maintenance worker died from being electrocuted when a ladder he was on became entangled in live power lines.

The Consumer Product Safety Commission states that 160,000 people are injured in ladder-related accidents each year. They also say that the number of accidents dramatically increases around the holiday months.

The Texas slip and fall injury lawyers with Daniel Stark Injury Lawyers advise that the best way to stay safe on a ladder this holiday season is to:

  1. Always have a spotter below you hold the ladder
  2. Make sure the ladder is firm and steady at a 45-degree angle before climbing
  3. Never go above the top wrung

Honda Recalls 304,000 Vehicles Due To Faulty Airbags

December 6, 2011

The Japanese Automaker, Honda Motor Company, announced late last week that they are recalling 304,000 vehicles from around the world due to an airbag fault. According to ABC News, 273,000 of those vehicles are in the United States and Canada.

The recall is being issued in response to defective airbag inflators that could, in the case of an accident, over inflate airbags causing them to burst. An explosion of this caliber could send metal shards and debris flying that could potentially cause injuries or death. Honda acknowledged that 20 accidents and two deaths, both of which occurred in 2009, have been associated with the recall.

Affected models include:

  • 2001 and 2002 Accord
  • 2001 to 2003 Civic
  • 2001 to 3003 Odyssey
  • 2002 and 2003 CR-V
  • 2003 Pilot
  • 2002 and 2003 Acura 3.2 TL
  • 2003 Acura 3.2 CL

This most recent recall will now bring the tally up to six total recalls the company has made since 2008 for the same problem. An estimated two million cars, vans, trucks, and SUV’s made by the company have been recalled over that 3-year period. Earlier this year, the company recalled 700,000 vehicles for stalling engines.

Doctors Warn That Colored Contacts Could Be Dangerous

October 4, 2011

Colored contacts are everywhere! They are popular way for teens and young adults to change their everyday eye color. With Halloween right around the corner, many are using them to add spooky detail to their costume. However, some people don’t realize the dangers these contacts can present for your eyes.

KVUE News interviewed Dr. Eric Poulsen, M.D., who has treated numerous patients suffering from a range of afflictions ranging from mild eye irritation to severe cornea ulcers as a result of using cheap non-prescription contacts.

Experts say the best way to combat this problem is to simply have an eye exam before purchasing and wearing any contacts. Dr. Poulsen stated, “There is nothing inherently wrong with these contacts, the question is, are the right shape and size for your eye?”

Also make sure to properly store, clean, and apply the contacts correctly. Often, directions are not included in the packaging of these cheaper versions of contact lenses. Poor handling of contacts can often lead to infection.

Arlington Billboard Worker Falls to His Death

August 16, 2011

A man hanging a billboard in Arlington, Texas, fell to his death on Monday afternoon. According to a report by News Channel 25, the Tarrant County Medical Examiner’s Office identified the victim as a 40-year-old man from Boyd, Texas.

The man was on the billboard near Cowboys Stadium midday Monday when he suddenly lost his footing and slipped, falling approximately 30 feet before hitting the ground. Witnesses immediately called 911, and rescue workers transported the man to Arlington Hospital; however, it was too late for the man by the time they arrived and he was declared dead.

Investigators with several agencies, including the Occupational Safety and Health Administration (OSHA), are looking into the incident to determine whether the worker was wearing a safety harness at the time of the accident, and if he was, whether it was properly attached.

The Bureau of Labor Statistics reported an all time high for fatalities resulting from falls while on the job in 2007, with a total of 847 deaths. The US Department of Labor named falls as one of the leading causes of traumatic death on the job, accounting for 8% of all reported worker deaths.

Houston Man Sues After Suffering Stroke Caused By Baseball Equipment

May 24, 2011

A Houston man has filed suit against the makers of baseball umpire’s chest protector he was wearing that he claims caused him to have a stroke. The Southeast Texas Record is reporting  that the man claims the Diamond Baseball Co.’s equipment shifted up on his neck as he was driving home from a little league game he had just umpired. When the chest piece shifted up, it severed the right internal carotid artery. The man did not realize the internal injury had occurred and suffered from nausea and headaches when he arrived home. The extent of the damage caused was not discovered until the next morning when the man’s wife found him incapacitated on the couch and unable to move his left side. He was then transported to a local hospital where he was diagnosed with a right middle cerebral artery infarction.

Court documents claim that the cut caused an immediate stroke that has left the man permanently disabled, suffering from left hemi-paresis, executive functioning disorder, bouts of fecal and urinary incontinence, seizures, aphasia, and cognitive deficit.

The man is seeking over $75,000 in damages

Auto Accident Kills One and Injures One In Georgetown, Texas

May 17, 2011

An auto accident left one young man dead and another seriously injured after the vehicle they were traveling in crashed into a home in Georgetown, Texas. The Statesman reports that the accident occurred when the driver of the two-door convertible lost control of the vehicle and crashed into the home around 7:00 AM on March 30, 2011.

The article quotes a police officer as saying “The vehicle left the roadway, struck a privacy fence and a rock column, and then hit the rear corner of the house in the 900 block of Boquilla Trail.”

The passenger was killed, and the driver is in critical condition. The occupants of the house were not injured in the accident, although they sustained property damage to their fence and home. The officer stated that speed was a factor in the accident.

The Insurance Institute for Highway Safety says that speed plays a factor in one third of all fatal accidents. Many times, the driver of a vehicle involved with a high-speed fatal accident can be found at fault for injuries or wrongful deaths of others involved.

If you or someone you know has been injured due to a high-speed accident, contact an Austin, Texas, Personal Injury Lawyer at Daniel Stark Injury Lawyers.
