Cooler Weather = Time For Immunizations

October 18, 2011

With Cooler weather around the corner, many citizens are beginning to protect themselves from winter’s illnesses with flu shots. Another important immunization to receive often falls to the way side though, costing hundreds of children and the elderly their lives every year.

That shot is a pneumonia immunization. KVUE News reports that children are urged to receive the shot because it can help ward off deadly bacteria that can cause meningitis, a disease that can lead to blindness, deafness, and death. On the other hand the elderly are encouraged to be immunized because of weaker immune systems.

Until recently, only this demographic was asked to be immunized for their higher risk of health complications associated with pneumonia, but now, researchers are also encouraging those with asthma between the ages of 19 and 65 to also be immunized as they run a higher risk of pneumonia bacteria passing from the lungs to the blood stream.

Researchers have discovered that these immunizations in recent years have lead to fewer ear infections in children and lowered the number of overall infections in adults over the years.

Dr. Bill Howland with the Allergy and Asthma Center of Austin says normally the shot is only needed one time, but a booster shot later in life may be needed.

The Texas Medical Malpractice Attorneys with Daniel Stark Injury Lawyers encourage those individual in these age groups to go get immunized. The decision may keep you healthy through the winter, but more importantly, may save your life.

Man Falls Off Train Bridge in Austin, Texas

October 11, 2011

A 64-year-old man was injured in Austin, Texas, Monday evening after falling from a railroad bridge. Authorities say the man was walking along the Cap Metro train bridge at Adelphi Lane and Waters Park Road just before dusk. KXAN News reports that an approaching train caught the man in the middle of the 30-foot high bridge with nowhere to go.

Austin-Travis County EMS workers say they believe the man either jumped from the bridge or was blown off by turbulence from the swiftly passing train, but that the train did not hit the man. The man was conscious and responsive when the EMS arrived, but needed immediate treatment for several leg fractures he suffered. Paramedics transported the man to Round Rock Hospital where he was treated and released.

The Texas Personal Injury Attorneys with Daniel Stark Injury Lawyers encourage all readers to stay off train tracks at all costs. However, if you have been injured while on or near a train, the experienced team at Daniel Stark Injury Lawyers is available anytime to discuss your case.

Doctors Warn That Colored Contacts Could Be Dangerous

October 4, 2011

Colored contacts are everywhere! They are popular way for teens and young adults to change their everyday eye color. With Halloween right around the corner, many are using them to add spooky detail to their costume. However, some people don’t realize the dangers these contacts can present for your eyes.

KVUE News interviewed Dr. Eric Poulsen, M.D., who has treated numerous patients suffering from a range of afflictions ranging from mild eye irritation to severe cornea ulcers as a result of using cheap non-prescription contacts.

Experts say the best way to combat this problem is to simply have an eye exam before purchasing and wearing any contacts. Dr. Poulsen stated, “There is nothing inherently wrong with these contacts, the question is, are the right shape and size for your eye?”

Also make sure to properly store, clean, and apply the contacts correctly. Often, directions are not included in the packaging of these cheaper versions of contact lenses. Poor handling of contacts can often lead to infection.

Bastrop Residents and Officials Rebuild After Wildfires

September 27, 2011

In the wake of the Bastrop wildfires that burned thousands of acres, destroyed 1,600 structures, and killed two people just weeks ago, residents and government officials are working to put the area back together.

Several Bastrop residents have come together and filed a lawsuit against Bluebonnet Electric, saying they are responsible for untrimmed trees that sparked the fire. KVUE News reports that the Texas Forest Service officials determined that two untrimmed trees were blown into power lines by high winds, sparking two separate fires that would eventually merge together. Attorneys representing the three victims whose homes were destroyed stated in the claim that based on a similar 2009 case, in which the company was sued over a tree that sparked a fire, the company should have had reasonable foresight to cut the trees and could have prevented the fire. The company has denied responsibility and has several days to respond to the suit.

In order to prevent similar catastrophes from occurring in their town, firefighters and Texas Forest Service officials visited with residents of Leander, Texas, to educate them on how to protect the homes form wild fires. According to KVUE News, they discussed with citizens how to trim vegetation back form their homes and gave several other tips on how to fix potential fire hazards.

The Texas Fire Injury Attorneys with Daniel Stark Injury Lawyers are available anytime to answer questions if you have been injured, or your property has been damaged by a fire that was not your fault.

Two Texas Drivers Die Because of Distractions Behind the Wheel

September 20, 2011
Two men died last week from veering off the road due to distraction while driving. Channel 25 News reported that the two men died in separate accidents; one last Thursday and the other Saturday.
The first accident happened just after 7:00 AM Thursday morning on Highway 36 when a 48-year-old driver from Belton crossed the center line in his Jeep and collided head-on with a tanker truck. The crash claimed the life of the Jeep driver, and the driver of the tanker was airlifted to White Hospital to be treated for his injuries.
The second crash occurred just east of Willow Springs on Highway 90, when the driver of a westbound 2008 silver Hyundai Santa Fe, became distracted and veered off the road into a cable barrier system in the median. The vehicle skid along the barrier system until it ended and rolled into the eastbound lanes. Authorities say the driver suffered massive head trauma and died at the scene.
The US Department of Transportation reports that in 2009, 5,474 people were killed and an estimated 448,000 were injured on US roadways in accidents caused by distractions.
The Texas Auto Accident Attorneys with Daniel Stark Injury Lawyers would like to ask that drivers protect themselves and others on the road by putting your cell phones down while behind the wheel, adjusting the radio and mirrors before taking off, and focusing on the road while driving.

Bastrop Wildfires Ravage The Texas Hill Country

September 13, 2011

As residents slowly trickle back into the Bastrop, Texas, area following one of the largest wildfires the state has seen in years, hope is slim of finding homes and lives that have gone untouched by the flames.

The fire, which continues to burn in patches of areas weeks after starting, claimed the lives of two people. Separate Texas Motorcycle Crashes Kill Three, Injure One

September 6, 2011

For some Texans, Labor Day is synonymous with breaking out the motorcycle for a cruise. People get caught up in the fun though, and forget to put safety first. Two separate motorcycle accidents in the Austin area over the holiday weekend have left three people dead and one in critical condition.

KVUE news reported the first accident happened Saturday night, around 10:20 PM, on Dee Gabriel Collins Road. A 59-year-old man and a woman lost control of the bike and crashed, killing the man and leaving the woman in critical condition. Authorities are unsure who was driving at the time of the crash, but have determined the man was not wearing a helmet when the accident occurred.

The second crash happened early this morning when a motorcycle and car collided, throwing the rider of the bike from the vehicle. The accident occurred around 3:00 AM on the MoPac Expressway, near RM 2222. Authorities shut down the northbound lanes of MoPac as they investigated. The roads have since reopened; however, authorities are continuing their investigation into the moments surrounding the crash.

The Texas Motorcycle Accident Attorneys with Daniel Stark Injury Lawyers say the best way to protect yourself from injury when on a motorcycle is to always wear a helmet. It has been proven by the National Highway Traffic Safety Administration that thousands of motorcyclists who perished in crashes could have been saved had they been wearing a helmet.

Austin City Council Settles Wrongful Death Suit

August 30, 2011

Two lawsuits filed against the City of Austin, Texas, were closed last Wednesday after members of City Council voted on a settlement amount for victims of a police shooting. According to MYFOX-Austin, the city decided to pay the family members of one of the victims $750,000 so that the case would not go before a jury. The other man was paid $175,000 for the gunshot he sustained that night.

The incident occurred in 2009 when an officer with the Austin Police Department shot and killed the victim as the two struggled to gain control of a gun. The officer then shot the other man as well. A grand jury cleared the officer of any wrong doing, but an independent report found he had used excessive force during the incident.

Council members voted last week after realizing it would cost close to $100,000 just in attorney fees to take the case to court. Council member, Sheryl Cole, reiterated the uncertainty of trials by saying, “Everybody knows attorneys cost a lot of money and a trial doesn’t guarantee anything it’s a roll of the dice at best.”

Council members said after the vote that they hope the decision will bring the community closer and lay to rest hostility that has built amongst factions on both sides of the argument.

Austin Crash Kills Two And Injures Two Children

August 23, 2011

A crash on Austin’s MoPac Expressway cost two people their lives, and injured an infant and another child Sunday afternoon. KVUE News reported the accident happened just after 6:00 PM in the northbound lanes, just south of Steck Avenue.

The single car accident happened when the driver lost control of the vehicle and drifted onto the inside shoulder of the road, where it struck a guardrail and rolled into the southbound lanes. The two adult passengers were killed in the crash and declared dead at the scene, while the children occupying the vehicle were taken to Dell Children’s Hospital to be treated for the injuries they sustained. Investigators say they believe speed was a contributing factor in the incident. It took authorities several hours to reopen the road and for traffic to return to normal.

Speed often plays a contributing part in fatal crashes because of the greater impact caused the point of collision. The National Highway Traffic and Safety Administration (NHTSA) says speed is one of the top three contributing factors in fatal highway crashes, just behind alcohol and distracted driving.

If you have been injured in a crash caused by another driver’s negligent speeding, contact the Texas Auto Accident Lawyers with Daniel Stark Injury Law. They work to help victims of car crashes get through the difficult times after crashes and collect the compensation they need to move on with their lives. Their lawyers are always available to discuss your case confidentially with you for free.

Arlington Billboard Worker Falls to His Death

August 16, 2011

A man hanging a billboard in Arlington, Texas, fell to his death on Monday afternoon. According to a report by News Channel 25, the Tarrant County Medical Examiner’s Office identified the victim as a 40-year-old man from Boyd, Texas.

The man was on the billboard near Cowboys Stadium midday Monday when he suddenly lost his footing and slipped, falling approximately 30 feet before hitting the ground. Witnesses immediately called 911, and rescue workers transported the man to Arlington Hospital; however, it was too late for the man by the time they arrived and he was declared dead.

Investigators with several agencies, including the Occupational Safety and Health Administration (OSHA), are looking into the incident to determine whether the worker was wearing a safety harness at the time of the accident, and if he was, whether it was properly attached.

The Bureau of Labor Statistics reported an all time high for fatalities resulting from falls while on the job in 2007, with a total of 847 deaths. The US Department of Labor named falls as one of the leading causes of traumatic death on the job, accounting for 8% of all reported worker deaths.
